Deaton Says SEC v. Ripple Isn’t the Only Case Delayed By Judge Torres

Pro-XRP lawyer Deaton has highlighted several cases under Judge Torres’ jurisdiction that took an equal amount of time as the Ripple lawsuit.

Attorney John Deaton, the Crypto-Law.US founder, has taken to Twitter to address the widespread rumor regarding the SEC-Ripple lawsuit.

Deaton Sees Nothing Strange in Judge Torres’ Delay

For context, several rumors have emerged in the past week following Judge Analisa Torres’ delay in issuing a decision for the SEC v. Ripple case.

Some XRP community members alleged that the delay suggests that Judge Torres is working in favor of the SEC. As these allegations gained traction, Attorney Deaton clarified nothing was strange regarding the delay.

Notably, Attorney Deaton emphasized that the SEC and Ripple filed their summary judgment reply briefs in December 2022. That said, Deaton said the final verdict for the lawsuit has now lingered for seven months.

Other Cases That Faced Similar Delay

Interestingly, attorney Deaton pointed out that the Ripple lawsuit is not the only case before Judge Torres that has lingered for months without a summary judgment decision.

According to Deaton, the Thor Equities’ case, under Judge Torres’ jurisdiction, is still pending for seven months. He explained that the parties in the case filed their summary judgment replies in December 2022.

Furthermore, Deaton shared other cases presided over by Judge Torres, which also took several months before she ruled.

Notably, the most protracted case Deaton came across was the New York District Capital Fund case. Per Deaton, Judge Torres issued her summary judgment decision eight months after the parties filed their reply briefs.

Additionally, Deaton said it took the judge seven months to issue her decision for the Quiller Inc. v. USA lawsuit. Similarly, in the Fitzgerald case and other lawsuits Deaton encountered, it took Judge Torres six months to rule.

Deaton said that while he and other legal experts speculated that Judge Torres would have issued a ruling by now, other cases under the judge’s jurisdiction have also taken equal time as the SEC v. Ripple lawsuit.

Deaton asserted that Judge Torres understands the magnitude of her ruling. Hence, she is taking her time to avoid making mistakes.

Deaton and Ripple CTO Call for Patience

It is worth noting that Deaton’s tweet addresses XRP community members who suggest that Judge Torres’ delay is strange.

XRP community members have taken to Twitter to express their frustrations with the delayed ruling. Over the weekend, some enthusiasts proposed that people write letters to the judge to get her to expedite the ruling.

However, attorney Deaton warned against contacting the judge, as doing so might have severe consequences. Meanwhile, Ripple CTO David Schwartz recently gave his expected timeline for Judge Torres’ ruling.

Schwartz expects the ruling to come on or before September 30. However, if the ruling does not come by then, Schwartz said he might think something is wrong and unusual.
