Another Win for Ripple as Judge Analisa Torres Denies SEC’s Request to Seal Its Objection to Amici Participation

0

Ripple recorded yet another win as Judge Torres denies the SEC’s request to seal its objection to the amici’s participation in the expert challenge.

In less than 12 hours after Ripple objected to the SEC’s move to seal its objection to amici’s participation in the upcoming expert challenge, Judge Analisa Torres has denied the Securities and Exchange Commission’s request.

Judge Torres noted that she chose to deny the SEC’s request to seal because the issues raised by the agency in its motion only apply to certain information and not the entirety of the opposition.

“Because only some of the information in the brief relates to the concerns raised by the SEC, the court does not believe sealing of the brief in its entirety is warranted,” Judge Torres rules.

The development was shared on Twitter by attorney James K. Filan.

Ripple Kicks Against SEC’s Request to Seal

Recall that the SEC moved to seal its opposition to amici’s request to participate in the expert challenge of Mr. Patrick Doody due to safety concerns of the expert. The SEC fears that publicly filing its opposition to amici’s request to participate in the expert challenge may pose a threat to Mr. Doody’s life.

However, Ripple and Individual Defendants did not agree to the reasons cited in the SEC’s seal request. The blockchain company noted that four of the five reasons the SEC cited in the request letter do not reflect any threat to life.

Based on this, Ripple urged the court not to allow the Securities and Exchange Commission to seal its entire opposition, adding that the agency should publicly file those portions that do not contain confidential information that could put Mr. Doody’s safety in jeopardy.

“Defendants do not oppose narrowly tailored redactions to serve the safety interests the SEC has identified. But the proposal to redact the entirety of its filings is overboard. The court should deny the SEC’s motion and order the agency to propose appropriately tailored redactions,” Ripple added.

The blockchain company urged the SEC to narrow down its sealing request because the agency’s initial proposal seemed “manifestly overboard.”

Judge Torres Orders the SEC

Following Ripple’s request, the Securities and Exchange Commission has been ordered to file by June 14, 2022, a redacted version of all briefs and exhibits under seal, which redacts information to the extent “necessary to safeguard information sought to be filed under seal.”

On June 14, 2022, the SEC is also required to file a letter, which will explain its proposed redactions and specify the exhibits the agency intends to seal.

Ripple and Attorney John Deaton Respond to the SEC’s Recent Motion

The blockchain company is requesting that the court denies the SEC’s request to redact the entirety of its objection letter.

Ripple has filed a response to the Securities and Exchange Commission’s motion to seal its objection to attorney John Deaton amici’s brief.

According to a motion filed by Ripple and Individual Defendants, Chris Larsen and Brad Garlinghouse, the trio has objected to the SEC’s request to seal its opposition to the amici request to represent 67,300 XRP holders in Mr. Patrick Doody’s expert testimony challenge.

Recall that, on June 7, 2022, the SEC pleaded with the court to seal its opposition to the amici brief due to safety concerns for Mr. Doody.

“Plaintiff Securities and Exchange Commission respectfully requests that the court order the sealing of the SEC’s letter in opposition to the motion by six XRP investors to file a brief regarding the opinion of one of the SEC’s experts [Doody],” the SEC said in its motion.

Ripple Disagrees With the SEC

However, the move did not go down well with Ripple and Individual Defendants, who have called on the SEC to redact portions of its opposition that may jeopardize the safety of Mr. Doody.

Out of the five reasons the SEC cited, four of these concerns do not reflect such concern, Ripple argued.

While Ripple noted that it is concerned about Mr. Doody’s, it demanded that the SEC should make public the four reasons that do not in any way risk the safety of the agency’s expert.

“The rest of the [SEC’s objection to amici request to participate in the upcoming expert challenge] should be publicly filed,” Ripple argued.

The blockchain company noted that the SEC’s sealing request should be narrowed down as it appears to be manifestly overboard.

Ripple and Individual went further to highlight sections that do not contain any confidential information that should be publicly filed by the SEC in line with the presumption of public access to court records.

Furthermore, the blockchain company and its execs noted:

“Defendants do not oppose redactions that are narrowly tailored to serve the safety interests the SEC has identified. But the proposal to redact the entirety of its filings is overboard. The court should deny the SEC’s motion and order the agency to propose appropriately tailored redactions.”

Attorney Deaton’s Response to the SEC

In the same vein, attorney Deaton also responded to the SEC’s opposition to the amici brief, in a bid to correct one of the agency’s interpretations, which noted that the Court’s rules “do not allow reply briefs in connection with pre-motion letters.”

Attorney Deaton objected to the SEC’s interpretation, saying its motion was properly labeled and filed as a motion letter, thus implying that it deserves to be responded to.

Do Kwon Makes A Twitter Comeback To Deny All Negative Reports About Terra

Terra’s CEO has finally responded to numerous allegations about his company.

Recently, numerous reports have been about the Terra incident and how the TerraForm Labs (TFL) team handled the situation.

Responding to these unfavorable reports about TFL, Do Kwon, the CEO, and founder of the company has dismissed these reports, claiming they are false but his Twitter still remains private.

Kwon’s Response to Negative Reports

The Terra exec took to microblogging platform Twitter to comment on recent reports about the company during the days when the project was still under development.

Recall that earlier this week, an anonymous “Terra’s Anchor program developer” alleged that Kwon refused to heed warnings that the cryptocurrency project will crash if he raises interest rates above 3.6%.

The “core developer” noted that he was shocked to find out that Kwon would be launching the Terra project at a ridiculously high interest of 20%.

Kwon, via his Twitter account, noted that the report is false while urging the cryptocurrency community to run a quick check on Terra’s code to discover whether such occurred.

“Open source development is transparent, and I would urge the media to check if a single line of code by your ‘experts’ has ever made it into production,” Kwon said.

for the airdrop he said:

“while TFL intends to continue supporting and building on the Terra 2.0 network, it is not by any means a “TFL-led” chain – we consciously bowed out of airdrop allocations and all the decisions are being made by various community groups, albeit in a rocky fashion.”

More Negative News About Terra

Meanwhile, reports about Kwon ignoring “expert” advice on the expected collapse of Terra should the project offer higher interest, is not the only negative news about the company in recent times.

As reported, a South Korean police official disclosed to Bloomberg today that TFL employees are under investigation for embezzling its Bitcoin reserve.

“The Seoul Metropolitan Police Agency is investigating a report about a “suspicious” crypto wallet that may have been used to embezzle Bitcoin, an official said by phone on Thursday,” Bloomberg reported today.

In other reports, some employees of the TFL reportedly told the United States Securities and Exchange Commission (SEC) that Kwon had engaged in a money laundering scheme.

The employee noted that Kwon used the scheme to transfer as high as $80 million monthly to a crypto wallet and to other foreign accounts prior to when the unfortunate incident befell the company.

The development is one of the reasons why the SEC is planning to charge Kwon and his company for their roles in causing massive losses to investors.

Kwon to be Proactive In Communicating to the Press

Based on the numerous negative reports about the company in recent times, Kwon has stated that TFL and the company will be more proactive in communicating to the press going forward, in order to disclose the right information to the public.

For the time being, Kwon has taken his Twitter account private, allowing only a handful of his followers to gain access to his account going forward.

While it is not clear why he took the stringent action, Kwon suggested in today’s tweet that Terra’s builders need to be left alone to concentrate, as these negative reports could cause distractions.

“I remain excited by the continued passion and ingenuity of Terra’s builders as the community navigates this difficult time – let’s leave them alone to build,” Kwon added.

VeChain Signs $100 Million Deal In Its First Ever Sports Sponsorship With UFC

VeChain hasn’t signed any sports-related logistics deal in its seven years of existence – until now.

VeChain, a blockchain-based logistics company, has inked a deal with the UFC. The deal will see VeChain manage MMA fighter rankings and be part of a sports sponsorship program. This is the first sports-related deal VeChain has signed in its seven years in the market.

Largest Ever MMA Sponsorship Deal

Apparently, this deal between UFC and VeChain is the largest ever in MMA history. The $100 million contract will run for a minimum of 5 years. With the agreement, VeChain became UFC’s “official blockchain partner.” This will translate into vast global exposure for the blockchain company and possibly bring more similar deals it’s the way.

For instance, VeChain will activate its new branding rights during the coming UFC events slated for this weekend in Singapore. The company will also be sponsoring fighter ranking for the MMA, which will now be referred to as “UFC Rankings Powered by VeChain.” This will be an excellent opportunity for VeCahin to showcase its works to the world and attract more crypto and blockchain industry attention.

VeChain new rights will be highlighted in broadcast and social media integrations along with branding in the Octagon.

More Blockchain-Related Deals To Be Made In Sports

VeChain’s debut into the sports sector serves to break the ice for more blockchain-based companies to get involved in sports. For the record, UFC already has other deals with Crypto.com and Socios. However, it’s the first time it has employed blockchain technology in a capacity such as VeChain’s logistics capability.

Speaking about the deal, UFC’s head of global partnerships, Paul Asencio, said,

“There’s been a lot of focus on digital currency, but this is an example of how powerful blockchain technology can be in other areas. “I can see many deals like this one coming across sports.”

UFC Revenues Are Up 30%

The deal is already affecting UFC revenues positively, with a 30% increase already recorded. This supports the notion that integrating blockchain technology in sports could revolutionize the sector and boost revenue. Technology is expected to grow the sports sector by over 700% in the next five years.

TFL Employees Told SEC That Do Kwon Cashed Out Hundreds Of Millions Of Dollars Months Before Terra Imploded

Key Terra employees interviewed by the US SEC have revealed a potential money laundering scheme run by Do Kwon.

Since the collapse of Terra Luna and UST and the subsequent launch of Terra 2.0, all eyes have been on Do Kwon and his team at Terraform Labs. Numerous allegations have been leveled against the founder and TFL, with some carrying strong evidence. Even the South Korean authorities have launched an investigation into TFL and Do Kwon.

Now, the US SEC is getting involved. According to information revealed by Naver, Do Kwon knew that Terra was about to go down months prior. Apparently, within those months, Kwon cashed out lots of money from company funds.

$80 Million A Month

Apparently, Do Kwon was very keen to cash out as many funds as possible before Terra Luna went down. The interviewed employees have confirmed to the SEC that Do Kwon transferred funds to the tune of $80 million a month from company funds to secret crypto wallets and foreign bank accounts. Basically, this is akin to money laundering, and US authorities don’t like that.

If these charges are proven with enough evidence, Do Kwon and TFL could find themselves in more trouble than they are right now. The two entities are already facing tax evasion charges in South Korea, with the taxman demanding around $78 million in tax settlement and fines.

They Predicted The Collapse Of Terra

Further reports from South Korean media reveal that Do Kwon and TFL were aware that Terra was heading for the brick wall months prior to the Luna and UST collapse.

The mentioned employees, who have been interviewed remotely, have confirmed that they warned Kwon about the potential looming danger pertaining to the design flaws of the Terra ecosystem, but Kwon ignored the warnings and went on with his money laundering racket.

Yesterday Terra Anchor Developer confirmed Do Kwon Deliberately Raised Interest From 3.6% to 20% A Week Before Launch making UST crash.

“Just before the launch, I suggested to CEO Kwon that the interest rate should be lowered, but it was not accepted,”

Today, a US Court ordered Terra’s Do Kwon and Terraform Labs to comply with the subpoenas issued by the SEC.

Based on data from WhaleStats, a crypto intelligence platform that tracks the activity of the largest Ethereum whales, “BlueWhale0159” has added an impressive amount of Shiba Inu to her portfolio.

Taking advantage of discounted prices, the Ethereum whale identified as “BlueWhale0159,” has scooped up a whopping total of 187 billion SHIB tokens, worth $1,985,940 ($1.98M) in one significant transaction, WhaleStats reports

This massive accumulation makes Shiba Inu her third-biggest holding position by dollar value followed by two stablecoins USD Coin (USDC) and Tether (USDT).

134.82 Million SHIB Burnt in Past 24 Hours:

On the other hand, Shibburn.com reports that the community has permanently moved out a total of 134,826,175 (134.82M) Shiba Inu tokens from circulation through 14 separate transactions. ETH SHIBA token burns an astounding amount of dog-themed cryptocurrency in the last 24 hours.

Top SHIB Burner of the Day:

The SHIB Burn project has shared a transaction link as a “Proof of Burn” with the Shiba Inu Community via tweet.

This is recognized as the project’s second massive SHIB Burn transaction in the last 7 days. Formerly on June 5th, ETH SHIBA destroyed 150 million Shiba Inu, worth $1,632 through one transaction.

In this way, ETH SHIBA has successfully moved a total of 240 million Shiba Inu tokens,  through two separate transactions in the last 7 days.

Impact on SHIB Price:

The recent massive ETH Whale accumulation and an astounding community burn failed to put a significant impact on the dog-themed cryptocurrency’s price. At the time of writing, Shiba Inu’s price is trading at the price of $0.00001069, showing almost no change over the last day, with a 24-hour trading volume of $388,085,029 ($388.08M).

New Terra Luna Classic (LUNC) Burning Proposal Receives 80% Votes In Favor, Will It Be Implemented?

A Proposal To Burn LUNC Causes A Jump In Price And 100% Increase In Trading Volume.

A LUNC investor has fielded a proposal to burn tokens and caused a sharp rise in price.

For some time now, the Terra community has complained that Do Kwon and Terraform Labs have abandoned LUNC and UST. An initial demand by the community for TFL to implement a LUNA burning mechanism was rejected, and Do Kwon and his team instead elected to create Terra 2.0.

Now, another proposal by a LUNC investor is causing ripples within the community and the crypto market. The proposal suggests a straightforward LUNC burning mechanism that will lead to a decrease in supply and an increase in price.

The LUNC Burning Mechanism

According to the proposal, a 1.2% tax/burn will be implemented on all LUNC transactions – both buy and sell. Every time a transaction is initiated, 1.2% of the tokens involved will be burned. This will create a situation where LUNC tokens will continuously decrease in the market. A decrease in supply means an increase in demand and that translates into an increase in price.

However, this burning mechanism will be halted once the total supply of LUNC tokens reaches 10 billion LUNC. After that, the supply will remain constant and will not be tampered with forthwith.

The proposal says:

“A Tax Burn mechanism is to be implemented on LUNC to reduce the Total Supply. Implement a Tax + Burn mechanism on each buy-sell transaction: 1.2% burn tax This mechanism should be true until the total supply = 10 billion LUNC, after that, this mechanism is disabled and the total supply can never be changed.”

Terra Team To Support It?

The proposal appeals to Terra to support the mechanism and make official announcements of the same on all social platforms.

Exchanges will also be needed to support the burning. Terra will share the official burning address on its social media outlets. This will work to stop the scams where people have been given false burning addresses and ended up sending their tokens to fraudsters.

Apparently, the 1.2% tax is a comfortable figure that the community can work with as opposed to earlier proposals that suggested higher percentages.

85% Support Proposal

Voting on the proposal is currently in progress, and close to 85% of the voters support the motion. These have over 133 million LUNA. Around 14% have abstained, while a measly 0.4% have voted NO with the vote.

These have just around 667,447 LUNA. From the look of it, the proposal is bound to pass. It’s yet to be seen whether Do Kwon, TFL, and exchanges will support LUNC burning.

LUNC is already reaping from the buzz created by the proposal. The coin is up 18% on the daily, and still going up. The price is now at $0.000073. The trading volume has also gone up by 107% in 24 hours to reach $349.6 million.
